Roslyn substitute teacher charged with sexually assaulting student

A substitute teacher at Roslyn High School was arrested Tuesday on charges that he raped a 15-year-old student off campus.

Timoteo Rodriguez, 29, of 27 Cumberland Ave., Great Neck, had sex with the girl on Dec. 2 while they were in the apartment of a friend of his on Knightsbridge Road in Great Neck, Nassau police said.

Rodriguez first met the girl while he was teaching at the high school where she was a student, police said. It was not clear how long they had known each other.

School officials said they first learned of the incident on Dec. 6. They immediately notified Nassau police and Child Protective Services and suspended the teacher without pay.

Rodriguez, who police said was arrested at his home, was charged with third-degree rape, disseminating indecent material to a minor and endangering the welfare of a child.

Third-degree rape is a Class E felony, punishable by up to 4 years in prison. The charge applies to someone 21 or older having sex with someone 17 or younger.

Neither Rodriguez nor a representative could be reached for comment last night. He is to be arraigned today in First District Court in Hempstead.

Roslyn School Superintendent Gerard W. Dempsey Jr. last night would confirm only that a teacher had been arrested, but declined to give his name or say how long he had worked for the district. Dempsey declined to provide any information about the incident.

After being told by Nassau police that the teacher had been arrested, the school district posted a notice last night on its Web site stating: "The school district is deeply concerned about the welfare of the student. As this is now a police matter, and out of concern for the privacy of the family, no additional information will be released by the district about the student or any specifics about the case."

Roslyn school officials said the teacher had undergone a state-required criminal background check and had been fingerprinted, and no prior criminal record was found in their review.
